Contest Terms & Conditions:

 

1. Promotion period is from 1st Nov 2013 to 15th April 2014.

2. The prizes for the Contest is as follows:

   1. Grand Prize : A pair of Cruise Tickets and a Pair of FIFA World Cup™ Match Ticket

   2. 1st Runner up: 1 Pair of FIFA World Cup™ Match Ticket (match to be determined at a later date);

   3. 2nd Runner up: 1 Pair of FIFA World Cup™ Match Ticket (match to be determined at a later date).

   ("Draw Prize(s)")

3. Subject to paragraph 4 below, each participant will receive one (1) contest voucher when they sign up for and/or install every 2kwp of Yingli modules with our System Installers appointed by Yingli Green Energy Singapore Company Pte. Limited ("authorised System Installers") during the promotion period ("Contest Voucher")

4. Participants eligible to participate are homeowners in Malaysia who commit to the installation of the Yingli solar system with a down payment of at least 50% with an authorised System Installer and who subsequently complete the purchase in accordance with applicable payment terms ("eligible participants"). For the avoidance of doubt, eligible participants are limited to individuals, i.e. homeowners only, and not businesses or companies.

5. Eligible participants have to answer all three questions in the Contest Voucher correctly in order to stand the chance to win a Draw Prize.

6. Yingli Green Energy Singapore Company Pte. Limited will choose the winners at random from the eligible participants who correctly answer all questions ("Winners"). Each eligible participant stands to win only one (1) Draw Prize.

7. Yingli Green Energy Singapore Company Pte. Limited will need to receive the particulars of the eligible customers by 18th April 2014 in order to be eligible for the lucky draw.

8. By participating in the Contest, all participants consent to Yingli Green Energy Singapore Company Pte Limited collecting and processing their personal particulars for administrative, publicity and commercial purposes. Winners also consent to co-operate with and participate in publicity activities organised by Yingli Green Energy Singapore Company Pte. Limited in relation to the Contest without payment of any compensation whatsoever. To the extent permitted by law, Yingli Green Energy Singapore Company Pte. Limited reserves the right to disclose and publish the names, photographs and such other personal particulars of the Winners to any persons and in such mode and manner as Yingli may in their sole discretion deem appropriate and for which Yingli Green Energy Singapore Company Pte Limited has obtained valid consent from the Winners and/or eligible participants.

9. The decision of Yingli Green Energy Singapore Company Pte. Limited on all matters relating to or in connection with this Contest (including the eligibility of a participant, the manner in which Draw Prize are awarded to each Winner and the conduct of the Contest) shall be final and binding on all parties concerned. Yingli Green Energy Singapore Company Pte. Limited shall not be obliged to enter into or entertain any correspondence with or complaint from any participant on any matter concerning the Contest.

10. By participating in the Contest i.e. by meeting the eligibility requirements, each participant agrees to abide by the terms and conditions stated herein. In the event the participant does not agree to these terms and conditions he/she should not participate in the Contest and should opt out by promptly informing Yingli Green Energy Singapore Company Pte. Limited of the same in writing.

11. By participating in the Contest, each participant indemnifies Yingli Green Energy Singapore Company Pte Limited and each of its respective successors, representatives and assigns against any and all actions, claims, including any third party claims, injury, liability, cost (including legal fees), loss or damage arising, directly or indirectly, in connection with this Contest, including any act or omission relating to his or her participation in the Contest, or the acceptance, possession, use or misuse of the Draw Prize, or any printing, typographical, administrative or technological errors in any materials associated with the Contest, howsoever caused.

12. Yingli Green Energy Singapore Company Pte. Limited reserves the right to replace the Draw Prize at any time at their discretion with another item of a similar value without notice.

13. The Draw Prize will be forfeited if unclaimed within 1 month from the date of notification by Yingli Green Energy Singapore Company Pte. Limited and shall be donated to a charitable organisation to be chosen by Yingli Green Energy Singapore Company Pte. Limited in its sole discretion. Any Winner whose Draw Prize has been forfeited shall not be entitled to any compensation notwithstanding non-receipt by him/her of any notification.

14. Winners may authorise another person to collect his/her Draw Prize on their behalf by providing this authorisation in the redemption letter sent by Yingli Green Energy Singapore Company Pte. Limited to the Winner. The redemption letter together with a copy of the Winner’s Identification Card, must be presented during the collection of the Draw Prize.

15. The Winner(s) shall accept the prize(s) in its "as is" state. Yingli Green Energy Singapore Company Pte. Limited makes no representation or warranty whatsoever as to the quality or fitness for purpose or any other implied terms or conditions with respect to the Draw Prize and assumes no liability or responsibility for the acts or defaults of the authorised System Installers or Winners or for any non-delivery, non-performance or defects in the Draw Prize. Any taxes, if applicable, will be borne by the respective Winners. For all purposes, Yingli Green Energy Singapore Company Pte. Limited is not an agent of the relevant merchant, i.e. FIFA ticket agent and/or the cruise agent ("Relevant Merchant"). Any dispute as to the quality or description of the prize must be resolved by the Winner(s) with the Relevant Merchant directly.

16. The Draw Prize(s) is neither transferable nor exchangeable for cash, credit or kind and shall be subject to such terms and conditions or as Yingli Green Energy Singapore Company Pte. Limited may in its sole and absolute discretion impose.

17. The use of the Draw Prize(s) is also subject to such other terms and conditions as may be imposed by the Relevant Merchant supplying the Draw Prize(s).

18. To the extent permitted by law, Yingli Green Energy Singapore Company Pte. Limited and its affiliates shall not be liable to the Winners for any loss, damage, costs or any expense incurred of suffered by the Winners, plus those of an indirect or inconsequential nature – including, without limitation, economic and other pecuniary losses.

19. Yingli Green Energy Singapore Company Pte. Limited’s liability (if any) shall be limited to the cost of the products purchased from the authorised System Installer and/or Yingli Green Energy Singapore Company Pte. Limited.

20. The Draw Prize(s) does not include the air tickets and all costs, charges and taxes associated with the air tickets or the cost of attending the FIFA World Cup™ or cruise.

21. The Draw Prize(s) does not include personal expenses, or meals, accommodations for the trip.

22. The Draw Prize(s) are transferable BUT cannot be exchanged for cash, credit or any other items.

23. The draw for the Contest will be held on 30th April 2014 ("Draw Date").

24. On the Draw Date, three (3) eligible participants of the Contest will be randomly drawn from the pool of eligible entries under the supervision of an external auditor. Yingli Green Energy Singapore Company Pte. Limited shall have the right to draw a "reserve winner" to replace any Winner who is subsequently disqualified for any reason, including without limitation, failing to answer the three questions in the Contest Voucher correctly.

25. The Winners will be notified by Yingli Green Energy Singapore Company Pte. Limited via ordinary post, phone and/or on the advertisement of newspaper.

26. Yingli Green Energy Singapore Company Pte. Limited strictly reserves its rights to amend and/or add to these terms and conditions of the Contest if necessary.

27. If any provision(s) of these Terms and Conditions is invalid or unenforceable, all remaining provisions will remain in full force and effect.

28. These Terms and Conditions shall be governed by the laws of Singapore.
